§ 23-11. Sidewalk repair and maintenance.

  • (a)

    It shall be the duty of all owners of lots fronting on streets having paved sidewalks to:

    (1)

    Maintain and keep the sidewalks in front of their lots in good repair by removing all uneven and broken sections and replacing them with such materials as will level the surface and make it uniform;

    (2)

    Provide sufficient drainage over or under the sidewalks to prevent the accumulation or standing of water on or near the sidewalks;

    (3)

    Prevent the growth or accumulation of weeds, grass, dirt or other nuisance on the sidewalks, or on the neutral grounds adjacent to such sidewalks.

    (b)

    It shall be the duty of the public works director to enforce the provisions of this section by notifying the persons subject to this section or their agents personally in writing, or by publication in the official journal of the repairs or maintenance necessary on their respective sidewalks, and it shall be the duty of such persons to make the repairs or maintenance within ten days of personal service or first publication of the notice in the official journal. In default of making such repairs or maintenance, the repairs or maintenance shall be made by the public works director at the expense of the owners of such property, and upon completion of the work, a statement of the amount due shall be served on the owners or their agents, which, if such amount is unpaid 60 days after service of such notice, on recording proof of the performance of the work in the office of the recorder of mortgages of the parish, shall constitute a lien and privilege upon the property until the sum due shall be paid, and the sum shall be collectible in any court of competent jurisdiction.
